WebMD skirts US trade secret claim over Latin American physician databases

By Melissa Ritti ( April 1, 2025, 13:01 GMT | Insight) -- A US judge yesterday rejected trade secret misappropriation claims against WebMD by Medcenter Holdings and its subsidiaries in Argentina, Mexico and Brazil. The dispute was one of the first to address the question of extraterritoriality under the Defend Trade Secrets Act, with US District Judge Andrew L. Carter Jr. concluding in 2021 that WebMD’s foreign conduct could factor into Medcenter’s recovery in the case. Ultimately, however, Carter said the claims were filed just months too late under the DTSA's three-year statute of limitations.WebMD Health, Medscape and WebMD Global must defend allegations they violated New York contract law but they are no longer facing claims under the Defend Trade Secrets Act....
