Elanco wins dismissal of Tevra Brands' US antitrust complaint

( March 31, 2025, 22:11 GMT | Official Statement) -- MLex Summary: Elanco Animal Health's motion to dismiss Tevra Brands' antitrust complaint has been granted, with leave to amend, by a California federal judge. Tevra sued Elanco on Aug. 1, the same day Bayer, at a jury trial against Tevra, defeated claims that it violated US antitrust laws. Bayer sold its animal health business unit to Elanco in August 2020. In her order, US District Judge Beth Labson Freeman said that she was granting Elanco's request to throw out the new complaint on the basis that Tevra’s claims are barred by the doctrine of res judicata and that Tevra is collaterally estopped from asserting the same antitrust market as it did in the Bayer action.See attached file....
