US FTC, Deere oppose OEMs' bid to block document disclosure in antitrust suit
( March 27, 2025, 23:32 GMT | Official Statement) -- MLex Summary: Non-party original equipment manufacturers CNH Industrial America, Kubota Tractor Corporation and AGCO Corporation should not be able to prevent the disclosure of documents and data provided to the US Federal Trade Commission during an investigation that has turned into antitrust litigation against Deere & Company in the Northern District of Illinois, the parties told a federal judge. The information at issue includes sales, pricing, and margin data; market share-related submissions to the Association of Equipment Manufacturers; and information about the OEMs’ dealer networks. Farmers pursuing similar claims in separate multidistrict litigation also opposed the OEMs motion for a protective order in a separate response. “MDL Plaintiffs position is simple: whatever documents or data John Deere receives from the FTC investigation; MDL Plaintiffs should also receive,” they said.See attached files....
