US trade court rules against ITC in confidentiality request

( March 27, 2025, 19:15 GMT | Official Statement) -- MLex summary: The Court of International Trade today ruled as unlawful the International Trade Commission's practice of automatically treating questionnaires from businesses as confidential. Judge Stephen A. Vaden said the ITC could not make certain information non-public in its remand results for phosphate fertilizers from Morocco and Russia. He wrote the agency had a "disregard for the legal rules governing confidentiality," which "abrogates the public’s right of access to judicial proceedings and impairs the Court’s ability to decide cases and issue opinions in a timely manner."Court document attached....
