US Chamber of Commerce supports US high court review of NTE antitrust case against Duke Energy

( March 27, 2025, 14:47 GMT | Official Statement) -- MLex Summary: The US Chamber of Commerce and other business associations filed a brief in support of Duke Energy’s petition for US Supreme Court review of NTE Carolinas’ antitrust case over electricity transmission, saying the court needs to reestablish that an antitrust claim can’t come from an amalgamation of meritless claims. They argued that allowing the appeals court decision to stand would result in antitrust plaintiffs flocking to the Fourth Circuit with complaints of “complex” anticompetitive schemes that cannot satisfy the Supreme Court’s clear tests.
