US DOJ tells court pricing algorithm can be antitrust violation

( March 26, 2025, 23:31 GMT | Official Statement) -- MLex Summary: The US Department of Justice told a federal court that using a common pricing algorithm can qualify as concerted action under the Sherman Act even if the competitors do not always use the algorithm in the same way, and that competitors’ exchange of competitively sensitive information can violate the law even if those exchanges occur through an intermediary. The DOJ filed a statement of interest in support of neither side in a case accusing MultiPlan and health insurers of conspiring to reduce the reimbursements they pay to healthcare providers for out-of-network healthcare services. See attached file. ...
