Amazon, Audible denied fees after prevailing in copyright clash with novelist

( March 26, 2025, 18:18 GMT | Official Statement) -- MLex Summary: US Judge Dora Lizette Irizarry of the Eastern District of New York denied a request by Amazon, its audiobook streaming service Audible and Urban Audio Books for attorney’s fees, on the heels of a February 2025 decision by the US Court of Appeals for the Second Circuit which affirmed the dismissal of plaintiff Teri Woods’ copyright infringement claims against them. In the same order, Irizarry denied a similar request from Blackstone Audio, also made pursuant to Section 505 of the Copyright Act. According to the judge, Woods’ claim that UAB had no right to sublicense her books to the co-defendants was not objectively unreasonable, nor made in bad faith. That Woods pursued discovery in advance of a decision on the defendants’ motion to dismiss does not qualify as “aggressive,” Irizarry ruled, and “punishing” the plaintiff under Section 505 could deter other copyright owners from asserting their rights in the future.See attached document....
