Trademark holders can block stocking of infringing goods, EU legal opinion says

A trademark holder can stop a third party from stocking infringing goods in one EU member state for sale in another where that trademark is protected, even if the third party exercises only indirect control over the goods' destination, according to a legal opinion prepared for the EU Court of Justice by Advocate General Dean Spielmann. The non-binding opinion, which judges will use in making a ruling, involves a case referred to the EU court by the German Federal Court of Justice, which sought clarification over whether a company stocking goods in one EU country could be held liable for infringement if those goods were intended for sale in another country where the trademark is protected.See court document attached.
