Swedish Match can't avoid US antitrust claims over smokeless tobacco, plaintiff says

( March 25, 2025, 15:02 GMT | Official Statement) -- MLex Summary: A plaintiff bringing US antitrust claims against Swedish Match North America over smokeless tobacco products opposed a motion to dismiss, saying it does not yet have to prove competitive harm, and the complaint shows a likelihood of economic concentration in a market or that the acquisition is likely to be harmful. “Swedish Match and Philip Morris’ Zyn product has an 80 percent market share in the MON product market and uses its monopoly power to continue to raise prices sans inter-brand price competition. Accordingly, defendants’ heavy-handed argument that plaintiffs do not allege anticompetitive harm is not one that should be decided at this stage,” the brief said. See attached file. ...
