Consumer claims over Apple’s App Store can be brought in Netherlands, EU court opinion says

( March 27, 2025, 10:02 GMT | Official Statement) -- MLex Summary: Mass consumer litigants may bring damages lawsuits against Apple at courts in the Netherlands over allegedly excessive fees charged due to “restrictive rules” used in the App Store, according to an EU court opinion issued today. In a non-binding opinion for the bloc's top court, Advocate General Manuel Campos Sánchez-Bordona recommended to rule that consumers can file claims in the country where they purchased the apps. Today's guidance follows a request made by a court in Amsterdam asking whether jurisdiction rules allowing consumers to bring lawsuits at their local court are appropriate for broader class actions.The Advocate General opinion is attached.
