Tzell Travel fails to win dismissal of US travel agent commission price-fixing claims

( March 20, 2025, 22:51 GMT | Official Statement) -- MLex Summary: Price-fixing litigation brought against Tzell Travel from Flightblitz, Inc. and David Kaye will not be dismissed for a failure to prosecute, a California federal judge said. Inaction from plaintiffs' counsel did not prevent the defense from moving to compel discovery, public policy weighs in favor of disposition of cases on the merits, and "there are less drastic measures that can be taken instead of dismissal for failure to prosecute," US District Judge Consuelo B. Marshall said in an order denying Tzell's motion to dismiss in the Central District of California. See attached file....
