Amazon wins narrowing of US state claims over 'Project Nessie' pricing algorithms

( March 21, 2025, 00:28 GMT | Official Statement) -- MLex Summary: Amazon has won a decision in Seattle federal court dismissing claims by Pennsylvania and New Jersey that the company's "Project Nessie" pricing algorithm violated the states' consumer protection laws and Section 5 of the FTC Act. Despite allegedly using the pricing algorithms to mask consumers' view of its pricing increases while claiming it offers low prices, US District Judge John Chun ruled that Amazon’s pricing “justifications are non-actionable puffery" that didn't violate the state consumer protection laws because they are “vague promises of cost savings and competitive rates” rather than “measurable factual assertions” about its products.See attached document....
