Celsius seeks declaratory judgment in US trademark dispute with drinkmaker Eniva

Eniva sent a cease-and-desist notice to Celsius over the company’s use of the term “Vibe” in its flavor names in 2023 and has filed oppositions to seven Celsius trademark applications, which Celsius seeks to bring to an end with a declaration of noninfringement.Celsius filed suit today seeking a declaration of noninfringement in connection with “Vibe.” The District of Minnesota complaint asks the court to declare that Celsius’s use of “vibe” in connection with its energy drink line does not infringe Eniva’s identical “Vibe” trademark for its health drink....
