'Future focus' of merger reviews to be based on facts, Australian regulator says

However, in releasing its new merger guidelines today, ahead of the partial introduction of new merger laws on July 1, the Australian Competition & Consumer Commission also said the “future focus” of its merger reviews would remain based on “findings of fact.” The Australian government is now considering specific ex ante antitrust laws to take on the challenge of regulating digital platforms.Even without tailor-made ex ante antitrust rules in place, Australia’s competition watchdog says it’s ready to carry out merger assessments that amount to a “forward-looking exercise” to assess the future impact of a deal on a local market....
