Comfort Revolution wins US summary judgment of patent invalidity on inventorship grounds

( March 17, 2025, 10:10 GMT | Official Statement) -- MLex Summary: Patent infringement litigation over Comfort Revolution's "Therapedic Cooling Gel & Memory Foam Pillow" will not proceed, in view of a New Jersey federal judge's summary judgment of patent invalidity.  The ruling marks a blow to plaintiff The Green Pet Shop Enterprises LLC, who received US Patent No. 8,720,218 by assignment from Gerard Prendergast.  According to the court, “no reasonable jury” could deem Prendergast the sole inventor of the cooling composition he claimed in his patent application, because the "essential element" of the invention came from a factory in China.See attached document....
