Trade secret row belongs in Switzerland, US judge finds in dismissing case

While rejecting the defendants’ claim that the terms of Frank Hoefflin’s employment agreement require adjudication by the Swiss courts, a US judge said Switzerland represents “an available and adequate alternative forum” and that, because the defendants do not object to litigating there, dismissal is warranted.A forum selection clause in an employment agreement between Switzerland's Sika Technology Ltd. and its former executive Frank Hoefflin does not vest “exclusive” jurisdiction over disputes between the parties in Switzerland, or the US....
