Epic says Apple motion to strike US hearing testimony should be denied

( March 17, 2025, 18:00 GMT | Official Statement) -- MLex Summary: Epic Games urged a California federal judge to reject Apple's motion to strike certain testimony from a hearing over whether the smartphone manufacturer complied with a US injunction mandating changes to its anti-steering rules. In a court filing, Epic said Apple is "making the argument that Apple and its business executives reasonably believed in the propriety of Apple’s Injunction response, at least in part, on the basis of the advice of counsel on the appropriate way to solve what Apple viewed as a 'legal problem.'" But yet the company is seeking "to entirely conceal, and even strike testimony" that was elicited without objection. "Apple’s effort to conceal under the shroud of privilege evidence that directly contradicts Apple’s argument that its business professionals relied on advice of counsel to reasonably conclude their actions are compliant should be rejected," Epic argued.See opposition. ...
