Novartis wins relief in US on Entresto trade dress, but 'Novadoz' won't be enjoined

( March 17, 2025, 18:18 GMT | Official Statement) -- MLex Summary: US Judge Evelyn Padin of the District of New Jersey granted Novartis AG's request for a preliminary injunction barring three defendants from making use of the trade dress associated with "ENTRESTO" tablets but said Novartis is unlikely to succeed on the merits of its related claim of infringement over a generic version of the heart failure drug which will be marketed under the "NOVADOZ" brand. In the lawsuit, filed in January 2025, Novartis says MSN Pharmaceuticals, MSN Laboratories and Novadoz Pharmaceuticals LLC chose the name "Novadoz" to conjure in the minds of consumers a combination of "Novartis" and "Sandoz" — Novartis's former generics partner. That, according to the plaintiff, risks market confusion but Padin disagreed, declaring the "Novadoz" name "not confusingly similar." Under the terms of the preliminary injunction awarded to the plaintiff, the defendants must refrain from "manufacturing, producing, distributing, circulating, selling, marketing, offering for sale, advertising, promoting, or displaying the MSN Drug, in a manner likely to infringe on Plaintiffs' trade dress."See attached document....
