Roku fails to challenge UPC jurisdiction in Dolby and Sun Patent Trust disputes

By Inbar Preiss ( March 18, 2025, 13:07 GMT | Insight) -- The Unified Patent Court has dismissed Roku’s jurisdictional challenge in its dispute with Dolby International, which will allow Dolby to proceed with its infringement cases before the Munich Local Division. Roku’s objection, which argued that the UPC lacks jurisdiction due to alleged incompatibility with EU law, was rejected. Additionally, Roku's challenge in its dispute with Sun Patent Trust also raised concerns about the UPC’s jurisdiction, the right to a lawful judge and the validity of its opt-out withdrawal. These were also dismissed, with the court confirming its authority to hear the case.Dolby has scored a win from the Unified Patent Court, as the Munich Local Division confirmed its authority to hear the case, dismissing Roku’s attempts to shift proceedings to other jurisdictions. In a second court decision published today, Roku's jurisdictional and territorial objections were also rejected in its dispute with Sun Patent Trust....
