Grubhub can't shift US antitrust claims to arbitration, court rules

( March 13, 2025, 19:58 GMT | Official Statement) -- MLex Summary: Grubhub must face US antitrust claims over prices charged by restaurants in court, according to an appeals court. The US Court of Appeals for the Second Circuit affirmed an order that denied a motion to compel arbitration, finding that Grubhub’s arbitration clause does not apply to plaintiffs’ antitrust claims because those claims do not arise out of the terms of use. The panel said that the threshold question for plaintiffs’ claims against Uber and Postmates is for the court to decide. Circuit Judge Richard J. Sullivan dissented in part.See attached file. ...
