US FTC says Southern Glazer's motion to dismiss should be denied

( March 10, 2025, 16:00 GMT | Official Statement) -- MLex Summary: The US Federal Trade Commission told a California federal judge that Southern Glazer's motion to dismiss the agency's Robinson-Patman Act lawsuit against the company "misapprehends applicable case law, ignores key allegations, and overstates the factual detail required under the pleading standard." In its opposition to the motion to dismiss, the FTC argued that Southern's pricing practices "affected thousands of independently owned wine and spirits shops, neighborhood grocery stores, and local convenience stores, and harmed competition between nearby favored and disfavored retailers." The agency's complaint alleges that this conduct violates Section 2(a) of the Robinson-Patman Act and Section 5 of the FTC Act.See court filing. ...
