Belgian court seeks guidance on streaming platforms’ copyright obligations

( March 10, 2025, 09:01 GMT | Official Statement) -- MLex Summary: The Belgian Constitutional Court has asked top EU judges to clarify whether Belgium’s copyright law, which mandates an unwaivable and non-transferable right to remuneration for authors and performers, complies with EU law. The court questioned whether the law is justified and proportionate under the EU's Copyright Directive in a document published today in the EU's Official Journal. The request stems from a legal challenge by Google, Meta Platforms, Spotify, Sony Music Entertainment Belgium, and Streamz, among others, who argue that the law goes beyond the EU’s Copyright Directive. Following a hearing in September, the Belgian court referred questions regarding fair compensation, contractual freedom, and competition rules.See document attached. The case number is C-663/24....
