Direct purchasers receive class certification in US pharma antitrust litigation

( March 7, 2025, 16:17 GMT | Official Statement) -- MLex Summary: A Pennsylvania federal judge granted class certification in the generic pharmaceuticals pricing antitrust multi-district litigation to direct purchasers of clobetasol, which is prescribed for various inflammatory skin conditions, and clomipramine, an oral medication used to treat obsessive compulsive disorder. The direct purchaser plaintiffs contend that generic pharmaceutical manufacturers colluded in violation of federal antitrust laws to raise the price of clomipramine beginning in 2013 and clobetasol beginning in 2014. "Together, the benefit of litigating in one forum, the complexity of the MDL, and the importance of efficiently and effectively examining the antitrust allegations indicate that central adjudication of these issues is a superior path forward for this litigation," US District Judge Cynthia Rufe wrote in an opinion.
