Xiaomi entitled to unredacted ZTE patent assignment, negotiation docs, in US

By Melissa Ritti ( March 6, 2025, 14:31 GMT | Insight) -- A Texas federal judge is standing by his earlier holding that Xiaomi can pursue US discovery from a monetization firm and its subsidiary in connection with proceedings in Germany over a patent purportedly essential to the LGE standard. Longhorn IP and Ox Mobile Technologies must produce to Xiaomi an unredacted version of the assignment of the patent from ZTE Corp. to OMT, including the purchase price of European Patent No. 2,068,582. Under 28 U.S.C. § 1782, Judge Amos L. Mazzant of the Eastern District of Texas clarified, the burden to prove that requested discovery is “for use” in foreign proceedings “is de minimis.” Instead, he said, a party invoking the statute “need only show that the discovery it seeks is relevant.”Two years after asking US courts to help it unearth documents for use in foreign standard essential patent, or SEP, infringement proceedings, Xiaomi Technology Germany GmbH and Xiaomi Technology Netherlands B.V. (Xiaomi, collectively) took a big step forward yesterday, when a Texas federal judge refused to set aside his 2023 order granting their request for discovery....
