USW president files reply on dismissal of US Steel-Nippon antitrust suit

( February 28, 2025, 12:00 GMT | Official Statement) -- MLex Summary: United Steelworkers union President David McCall filed a reply supporting dismissal of US Steel and Nippon Steel's antitrust claims, arguing the plaintiffs downplay former President Joe Biden's role in blocking their merger, and that defendants' alleged conduct in a public campaign against the merger cannot be the basis for antitrust liability because of Noerr-Pennington protections. "It is evident from the Complaint that Plaintiffs’ alleged injuries stem from the failure of the Merger at the hand of the government, not any other conduct," McCall said in his filing to the Western District of Pennsylvania. US Steel and Nippon fail to demonstrate a restraint of trade, that there was specific intent on the part of McCall, or that McCall's alleged conduct was the cause of any breach or nonperformance under plaintiffs' tortious interference claims, the filing said.See attached document:...
