Ericsson breached ETSI obligation with SEP enforcement campaign: UK panel

( February 28, 2025, 11:17 GMT | Official Statement) -- MLex Summary: The UK Court of Appeal has undone a November 2024 ruling by UK High Court Judge Jonathan Richards, which denied a bid by Lenovo for a declaration of fair, reasonable and nondiscriminatory, or Frand, terms for an interim license to Ericsson’s standard essential patent portfolio. Judge Richard Arnold, joined by Judges Sarah Falk and Guy Newey, explicitly rejected the trial court's finding that Lenovo's request would interfere with principles of international comity, in a nod to Ericsson-initiated litigation in the US and injunctions issued on its behalf in Brazil and Colombia.  Instead, they ruled that "a willing licensor in the position of Ericsson would enter into an interim license with Lenovo." Under the Panasonic v Xiaomi framework for determining Frand terms, Arnold and his fellow panelists endorsed "a nine-figure dollar sum" representing "the mid-point between" the royalty proposed by Ericsson in October 2023, and Lenovo in January 2025.See attached document....
