Prevayl 'smart bra' patent infringed, but invalid, UK court rules

Judge Richard Hacon went on to find, however, that if Prevayl Innovation’s technology is later declared sufficiently inventive, it is infringed by the ‘Whoop 4.0’ sensor module by Whoop Inc. In so concluding, he articulated a new three-pronged inquiry for assessing when the supply of a product to a person not entitled to work an invention rises to the level of infringement.Whoop Inc. has successfully invalidated Prevayl Innovation’s patent for a “smart bra” in the UK....
