Inari sham litigation claim ‘the real sham,’ Corteva argues in seed patent row

By Melissa Ritti ( February 27, 2025, 01:27 GMT | Insight) -- Corteva Agriscience was in court today, defending the strength of its infringement case and pushing back on claims that it engages in patent misuse when enforcing plant variety protection certificates and seeking to restrict access to its seed deposits. Defendant Inari Agriculture, meanwhile, held firm on its allegation of sham litigation while also arguing why 200 unasserted Corteva utility patents should be held unenforceable. The latter request could be a bridge too far for the Delaware federal judge overseeing the dispute, who ended the two-hour hearing by admitting he harbors “case management concerns.”Agribusiness rivals Corteva Agriscience and Inari Agriculture remain very much divided in a dispute over five corn and soybean plant-variety patents which, with the benefit of time and discovery, has only grown since it was initially filed in September 2023....
