Music publisher can’t use ‘Ultra’ mark, but disgorgement denied in US trademark dispute

UIMP failed to establish that UR’s claims were equitably estopped. UR was granted a permanent injunction, though UR’s motion for profit disgorgement was denied.Ultra International Music Publishing’s (UIMP) equitable-estoppel defense to trademark infringement claims leveled against it by Ultra Records (UR), a former sibling company, fail, a Southern District of New York judge ruled yesterday.  A jury previously found in favor of UR, and the judge ordered UIMP to cease use of the term, though the judge denied UR’s motion for profit disgorgement....
