Schweppes wins EU General Court’s protection for ‘May Tea’ trademark

The court ruled that the conceptual similarity between the marks was weaker than previously assessed, as Latvian consumers would not automatically associate “May Tea” with May OOO’s Cyrillic trademarks.The EU General Court has upheld the validity of Schweppes International Ltd’s EU trademarks for “May Tea,” vacating an earlier decision by the EU Intellectual Property Office Board of Appeal....
