Fragrance companies fail to dismiss US price-fixing claims

( February 21, 2025, 22:14 GMT | Official Statement) -- MLex Summary: Plaintiffs bringing US price-fixing claims against four major global fragrance companies failed to establish person jurisdiction over the foreign companies, but their assertion of jurisdiction is not clearly frivolous, according to a federal judge. District Judge William J. Martini denied a motion-to-dismiss, finding that the corporate relationship between the foreign companies and their US subsidiaries is sufficiently opaque that, were the allegations concerning their US presence and degree of control exercised over their subsidiaries true, it would be unduly difficult to prove as much without the opportunity to conduct discovery.
