Madeira Free Zone tax incentives court defeat taken to top EU court

( February 17, 2025, 11:53 GMT | Official Statement) -- MLex Summary: Three companies active in the Portuguese territory of Madeira have filed an appeal at the Court of Justice of the EU to contest an earlier ruling by the lower court, which said that tax reductions granted to businesses in the Madeira Free Zone didn't create real economic activity and jobs. The companies appealing are Recubans, Register.com and Intercement Portugal. In an earlier appeal, the General Court dismissed an appeal by Register.com and Neottolemo. In 2020, the European Commission had ordered the recovery of state aid granted by Portugal. The applicants argue, among other things, that some advantages included in the scope of the commission's decision don't constitute state aid.The summaries of appeals are also attached. ...
