KME Germany launches appeal over inequitable-conduct holding by US judge

By Melissa Ritti ( February 13, 2025, 18:47 GMT | Insight) -- A January 2025 bench ruling in favor of China’s Zhejiang Hailiang Co. has been appealed to the US Court of Appeals for the Fourth Circuit. At issue are findings that KME Germany engaged in inequitable conduct when it opposed Hailang’s attempt to register the “HME” trademark in the US, given evidence KME was actively involved in the selection of “HME” for Hailang’s spinoff business. The German alloy manufacturer also opposed Hailang’s registration for the same logo in the European Union.KME Germany is pushing back against findings by a US judge that it committed inequitable conduct before the Trademark Trial and Appeal Board while opposing Zhejiang Hailang Co.’s application to register “HME” in the US....
