South Korea amends e-commerce decree to regulate online dark patterns

( February 10, 2025, 03:48 GMT | Official Statement) -- MLex Summary: South Korea has amended the E-commerce Act's enforcement decree and regulations to protect consumers from six types of deceptive online business practices known as "dark patterns," the Korea Fair Trade Commission announced. The new rules require businesses to obtain consumer consent 30 days before increasing subscription fees or converting from free to paid services, and require disclosure of any excluded fee items and their justification on the first advertising screen. The regulations also establish a graduated penalty system for violations: business suspensions of 3 months for first offense, 6 months for second offense and 12 months for third offense, along with fines of 1 million won (about $688) for first offense, 2 million won for second offense and 5 million won for third or subsequent offenses.
