ABBA wins EU trademark opposition, given ‘strong reputation’

By Inbar Preiss ( February 5, 2025, 17:03 GMT | Insight) -- ABBA’s record company, Polar Music International, successfully opposed an EU trademark application for “Viña ABBA” by Spanish winery Bodegas Francisco Casas. The EUIPO found that the contested mark could unfairly benefit from ABBA’s strong reputation, influencing consumer behavior in favor of the winery’s products. The Opposition Division rejected the application, concluding that “Viña ABBA” could take advantage of the pop band’s commercial and cultural recognition without due cause.The record company representing Swedish pop band ABBA has won its opposition to an EU trademark application for "Viña ABBA" filed by a Spanish winery. The EU Intellectual Property Office found that the proposed trademark by Bodegas Francisco Casas could unfairly benefit from the strong reputation of the "ABBA" trademark....
