Southern Glazer's moves to dismiss US FTC Robinson-Patman Act case

( February 3, 2025, 23:38 GMT | Official Statement) -- MLex Summary: Southern Glazer's Wine told a federal judge the US Federal Trade Commission's attempted revival of the Robinson-Patman Act against it represents a "legally flawed, factually unsupported waste of the agency's resources," and the complaint should be dismissed. The US FTC ignores that the structure of the liquor industry is intrastate — not implicating interstate commerce as required by the law, Southern Glazer's said in its memorandum filed to the Central District of California. The commission also fails to allege harm to competition by identifying comparable transactions between competing purchasers, cannot allege anticompetitive injury, and its claims under the FTC Act fail as dependent on its deficient Robinson-Patman claims, Southern Glazer's said.See attached file....
