Syngenta, Corteva US claims dismissed in crop protection products loyalty case

( January 28, 2025, 21:32 GMT | Official Statement) -- MLex Summary: Syngenta and Corteva's motion to dismiss farmers’ US federal claims accusing them of conspiring to block competition from producers of generic “crop protection chemicals” was granted due to plaintiffs being indirect purchasers. District Judge Thomas D. Schroeder concluded that the complaint does not permit the determination that only plaintiffs as end-users of the CPPs have paid any overcharge. “It is not alleged, for example, that the rebates paid to the intermediaries fully offset the supracompetitive prices they pay to defendants for the CPPs. Nor is it clear that the intermediaries do not use any portion of the rebates to lower their own prices for end users or farmers,” Schroeder wrote in the opinion. See attached file. ...
