Fujifilm’s infringement action dismissed by UPC; Kodak’s patent revocation upheld

( January 28, 2025, 09:30 GMT | Official Statement) -- MLex Summary: The Unified Patent Court in Düsseldorf has addressed both infringement action and a counterclaim for revocation in a dispute between Fujifilm and Kodak entities, concerning EP 3,594,009 B1. Fujifilm claims infringement by Kodak entities related to lithographic printing plate precursors. While the court found the infringement action admissible, it ruled the German part of the patent invalid, rendering the infringement claims in Germany unfounded. Additionally, jurisdiction over the UK part of the patent was confirmed, but the infringement claims for the UK also failed. The counterclaim for revocation was upheld.The order is attached....
