Plaintiffs oppose Cal-Maine Foods, United Egg Producers' request for new trial in US price-fixing case

( January 22, 2025, 23:31 GMT | Official Statement) -- MLex Summary: Cal-Maine Foods and United Egg Producers should not be granted a judgment in their favor or a new trial in a price-fixing case over eggs, plaintiffs told a US federal judge. “As this court correctly found in denying defendants’ Rule 50(a) motions, the evidence and law support the jury’s finding of liability and award of damages for the effects of defendants’ conspiracy to restrict hen supply and thereby raise egg prices. The same evidence and law compel the court to deny defendants’ Rules 50(b) and 59(a) motions. Plaintiffs proved that defendants and other egg producers, including Wabash Valley, organized and participated in a hub-and-spoke conspiracy to restrain trade in the national market for eggs and egg products, causing antitrust injury, including before August 2005,” they argued.
