Rain Carbon successfully protects 'Novares' trademark in EU General Court ruling

( January 23, 2025, 13:24 GMT | Official Statement) -- MLex Summary: Rain Carbon Germany won a challenge against Novaresine’s EU trademark application for “NOVARESINE INNOVATION GOES GREEN” at the EU General Court, which overturned an earlier EU Intellectual Property Board of Appeal ruling. Rain Carbon successfully protected its earlier “Novares” trademark. “The Board of Appeal erred in law by restricting its examination of the perception of the element ‘nova’ to that of a part of the relevant public of the European Union, in so far as, for that part of the relevant public, the signs at issue display a lower degree of similarity than for other parts of the relevant public,” the ruling says.See court document attached....
