Rain Carbon wins opposition in EU General Court

By Inbar Preiss ( January 23, 2025, 13:27 GMT | Insight) -- Rain Carbon’s German subsidiary successfully challenged Novaresine’s EU trademark application for “NOVARESINE INNOVATION GOES GREEN” at the EU General Court, securing protection for its earlier “Novares” mark. The court found errors in the EUIPO Board of Appeal’s 2023 decision, which they said wrongly overturned an earlier Opposition Division ruling favoring Rain Carbon. According to the EUGC, the Board failed to consider the perception of different European language speakers.Rain Carbon’s German subsidiary has won its bid to annul an EU trademark application by Novaresine, a sustainability-focused liquid resin producer, in a decision by the bloc's General Court that addresses the linguistic examination of trademark distinctiveness in different European languages....
