Delayed discovery rule applied in trade secret case over Seagate's HAMR drives

By Melissa Ritti ( January 22, 2025, 23:18 GMT | Insight) -- A motion by Seagate Technology to dismiss allegations it incorporated Access Optical Networks, or AON, trade secrets in its long-anticipated Heat-Assisted Magnetic Recording, or HAMR, storage drives has largely been denied. According to a US judge, AON conducted a reasonable investigation into its suspicions in 2018 but those suspicions were not crystalized until a series of Seagate patent filings were made public in 2021. Under the delayed discovery rule, the May 2024 lawsuit by AON was declared timely.Access Optical Networks, or AON, has successfully defeated a motion to dismiss by Seagate Technology, who stands accused of incorporating AON trade secrets in Seagate’s Heat-Assisted Magnetic Recording, or HAMR, data storage system....
