Juul Labs’ e-cigarette patent revoked by UPC in a win for Njoy

( January 17, 2025, 14:51 GMT | Official Statement) -- MLex Summary: Juul Labs International suffered a legal defeat when the Unified Patent Court revoked a patent related to electronic cigarette technology. The case, brought by e-cigarette producer Njoy’s Dutch subsidiary, claimed Juul’s patent lacked novelty and did not meet the "inventive step" requirements. Following a November hearing at the UPC Paris Central Division, the court ordered a revocation of European Patent 3,430,921 in Belgium, France, Germany, Italy, Luxembourg, the Netherlands, Portugal and Sweden, and the US-based Juul to cover the costs of the proceedings. The panel of judges concluded that the claimed invention was either disclosed by prior art, or would have been obvious to a skilled person in the field.See court document attached....
