Express Scripts loses early challenge to trade-secret misappropriation claims

( January 13, 2025, 16:04 GMT | Official Statement) -- MLex Summary: Allegations that pharmacy benefit manager Express Scripts violated the Defend Trade Secrets Act and Missouri state trade secret law when it used the identities, enrollment status and contractual relationship of pharmacies within plaintiff MHA Long Term Care Network’s database to solicit new customers are moving forward. A US judge in Missouri on Friday declared the claims adequate to withstand Express Scripts’ motion to dismiss because MHA asserts the information was proprietary and misused by the prescription processor. Other allegations against Express Scripts will be dismissed, however, including that it tortiously interfered with MHA's existing business relationships. At issue is a pharmacy service agreement between MHA and Express Scripts which the PBM is also accused of breaching.See attached document....
