UK Court of Appeal wipes out win for Dream Pairs Europe in dispute over logo

( January 26, 2024, 10:10 GMT | Official Statement) -- MLex Summary: The UK Court of Appeal has reversed findings by the High Court of Justice in favor of Dream Pairs Europe, which Iconix Luxembourg Holdings SARL had accused of infringing the double diamond logo of Iconix’s brand Umbro. Writing for the appellate panel, Justice Richard Arnold deemed post-sale confusion likely when the vantage point of an onlooker is taken into consideration. To that end, although Dream Pairs’ logo is boxy when viewed straight on, when viewed from above — as it would be during a football match — the diamond could be skewed to such a point it could be mistaken for the Umbro logo, Arnold said.
