Tempur Sealy's new slot commitment is worse, unenforceable, US FTC says

( January 3, 2025, 22:35 GMT | Official Statement) -- MLex Summary: The US Federal Trade Commission responded to a revised slot commitment submitted by Tempur Sealy and Mattress Firm, arguing that the new commitment remains unenforceable and is even worse than the initial proposal, according to court filings. "In fact, this new commitment is worse in many ways because it explicitly allows Tempur Sealy to judge its own compliance and permits Tempur Sealy to jettison the commitment at its whim. Because Defendants’ commitment does not mitigate the Proposed Acquisition’s anticompetitive effects, it should be given no weight," the agency argued.See attached document....
