Dissenting US judge cites improper fact-finding in 3G Licensing patent suit reversal

Although in agreement that the Patent Trial and Appeal Board "conflated obviousness with anticipation," Stoll wrote that the majority went too far by engaging in fact-finding instead of vacating and remanding. At issue is a PTAB ruling which confirmed a 3G Licensing telecommunications patent as valid.A divided US Court of Appeals for the Federal Circuit reversed a Patent Trial and Appeal Board decision today, finding the PTAB used flawed logic in upholding a 3G Licensing S.A. telecommunications patent as valid....
