US trade secret case against law firm, Chinese biotech company filed too late

( December 31, 2024, 10:10 GMT | Official Statement) -- MLex Summary: A US cancer research company saw its federal lawsuit against attorney Wansheng Jerry Liu and his law firm, Fox Rothschild LLP, over information Liu shared with a China-based pharmaceutical company dismissed with prejudice by a US court. Judge Edward S. Kiel of the District of New Jersey said Liu “confessed” the disclosure he made to Inventis Biotechnology in 2019, but Beta Pharma failed to formally allege trade secret misappropriation by Liu, the law firm and Inventis until October 2023, making the action untimely under the three-year statute of limitations provided for in the Defend Trade Secrets Act. Kiel declined to exercise supplemental jurisdiction of the remaining claims by Beta — each of which are premised on state law. At issue in the dispute is an epidermal growth factor receptor tyrosine kinase inhibitor named BPI-7711, which Beta says it invented but Inventis was first to patent in the US and China, after its existence was disclosed by Liu to Inventis’ director, Yueheng Jiang.See attached document....
