Roche Diabetes Care patent upheld by UPC; Tandem’s invalidity claims rejected

( December 19, 2024, 11:10 GMT | Official Statement) -- MLex Summary: The Unified Patent Court has upheld Roche Diabetes Care’s EP 2,196,231 B1, rejecting claims of invalidity made by Tandem Diabetes Care. The Paris Central Division examined whether Roche’s patent — which relates to a medication delivery device with a flexible reservoir — lacked novelty or inventive step in view of prior art. Tandem argued that various prior art medical patents, describing medication delivery systems and flexible containers, disclosed features of Roche's patent, including the mechanism for limiting the expansion of the flexible reservoir. The court found that the prior art patents did not disclose this specific feature, and that Roche’s patent was not obvious based on these references as a result. The patent was maintained as granted, and Tandem was ordered to bear the costs of the proceedings.See the court document attached....
