Ericsson patents valid, infringed, US trade commission says

( December 18, 2024, 17:25 GMT | Official Statement) -- Telefonaktiebolaget LM Ericsson is on its way to prevailing in a complaint lodged with the US International Trade Commission against Motorola Mobility, Motorola (Wuhan) Mobility and Lenovo. The initial determination by Administrative Law Judge MaryJoan McNamara says Ericsson proved under the preponderance-of-evidence standard that the respondents' importation of mobile phones violate Section 337 of the Tariff Act of 1930. According to McNamara, Ericsson established infringement of claims 10 and 13-15 of U.S. Patent No. 10,426,817, claims 8, 9, 15, and 17 of U.S. Patent No. 10,306,669, claims 34 and 39 of U.S. Patent No. 11,317,342 and claim 4 of U.S. Patent No. 11,515,893. All four patents are valid, McNamara ruled, and Ericsson satisfies the technical industry prong of the domestic industry requirement.
